By creating an account or using Court Climber ("Service"), operated by Court Climber ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Court Climber is a club-based ladder, tournament, and league management platform for racquet sports. The Service allows users to create and join clubs, participate in singles and doubles ladders, issue challenges, log match results, organize round-robin tournaments, and run scheduled league seasons. The Service is provided as a Progressive Web App (PWA) accessible via web browsers on any device.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service. You agree to notify us immediately of any unauthorized use of your account.
You agree not to:
Club owners and administrators are responsible for managing their clubs in accordance with these terms and are expected to address disputes between members in good faith.
Club owners retain responsibility for the content and management of their clubs. We do not endorse, verify, or guarantee the accuracy of any user-submitted content, including match results, player ratings, or club descriptions. You retain ownership of content you submit but grant us a non-exclusive, worldwide license to use, display, and distribute such content as necessary to operate the Service.
The Service, including its design, logos, trademarks, and software, is owned by Court Climber and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The Service relies on third-party providers including Firebase (data storage and authentication), Sentry (error monitoring), SendGrid (email notifications), and Vercel (hosting). We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURT CLIMBER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (including limitations of liability and intellectual property) will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Tennessee.
